The Department of Justice\u2019s attempt to overturn the ruling was rejected.<\/p>\n<p class=\"\" data-start=\"495\" data-end=\"657\">Judge Harvie Wilkinson criticized the government\u2019s actions, warning against denying due process. Despite the order, Garcia remains in El Salvador unless released.<\/p>\n<div class=\"code-block code-block-4\"><\/div>\n<p class=\"\" data-start=\"659\" data-end=\"900\">Trump adviser Stephen Miller argued the deportation was lawful and not mistaken, blaming misreporting and a former DOJ employee for confusion.
